If a client chooses to stop a project
Our approach is to account for work actually completed under the agreed scope, plus approved third-party costs that genuinely cannot be recovered, and return the unused balance of advance payments. Calling a payment a deposit does not automatically make all of it non-refundable. The applicable agreement and law govern each case.
How completed work would be valued
The proposal should define the milestone price or another agreed basis for valuing partial work. Any cancellation statement should show the work completed, payments received, approved costs and the remaining balance. This avoids inventing a price for unfinished work after cancellation.
Third-party purchases
Domains, platform subscriptions, paid themes and developer accounts should be identified and approved before purchase. Recoverability depends on the relevant provider and applicable law. A cost already recovered from a provider should not also be retained from a client. Direct client ownership and payment can make these arrangements clearer.
If the service is not delivered as agreed
A change-of-mind cancellation is different from incomplete or defective delivery. The outcome should reflect the agreement, the facts and the remedies required by applicable law, which may include a full or partial refund or correct re-performance. This draft does not make correction the client’s only remedy.
Ongoing care
Recurring care needs its own arrangement: the billing period, included work or reserved capacity, how future billing is stopped, and how unused prepaid amounts are treated. A new custom build and a monthly support arrangement should not share a blanket refund rule.
